1. Agreement to Terms

By accessing this website and/or purchasing products from Wicked Adventure Co. (“Company,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions.

If you do not agree, you must not use this website or purchase our products.

These Terms apply to all visitors, customers, and purchasers.

2. Eligibility

You must be at least 18 years of age to make a purchase.

If purchasing products intended for minors, you represent that you are the parent or legal guardian and accept full responsibility for the minor’s use of the product.

3. Products & Inherent Risk

Wicked Adventure Co. sells electric bikes and electric ride-on products designed for both adults and minors.

Motorized products involve inherent risks, including but not limited to:

  • Falls

  • Collisions

  • Loss of control

  • Battery-related hazards

  • Property damage

  • Serious bodily injury or death

By purchasing and/or using our products, you acknowledge and voluntarily assume all risks associated with their use.

4. Assumption of Risk & Release of Liability

To the fullest extent permitted by Arizona law:

You agree that Wicked Adventure Co., its owners, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Use or misuse of any product

  • Failure to wear protective equipment

  • Improper supervision of minors

  • Improper charging or battery handling

  • Modifications to the product

  • Violation of local or state laws

By purchasing a product, you release and hold harmless Wicked Adventure Co. from any claims, demands, or causes of action arising out of product use after transfer of possession.

5. Parental Responsibility

If a product is purchased for a minor:

  • The parent or legal guardian assumes full responsibility for supervision.

  • The parent or legal guardian assumes responsibility for ensuring the product is age-appropriate.

  • The parent or legal guardian assumes all risks associated with the minor’s use.

Wicked Adventure Co. does not provide supervision or safety monitoring.

6. No Shipping / Pickup Policy

Wicked Adventure Co. does not offer shipping.

All purchases are for local pickup by appointment only unless delivery is approved in advance.

Risk of loss transfers to the customer at the time of pickup or completed delivery.

7. Inspection & Acceptance

Customers must inspect products at the time of pickup or delivery.

By accepting possession, the customer acknowledges the product was received in satisfactory condition.

8. Product Use & Compliance

Customers are responsible for:

  • Understanding how to operate the product

  • Following manufacturer guidelines

  • Wearing appropriate protective gear

  • Complying with Arizona and local laws

  • Proper battery storage and charging

We are not responsible for injuries or damages resulting from misuse or failure to follow instructions.

9. No Warranties / Disclaimer

Except where prohibited by law, products are sold “AS IS” and “AS AVAILABLE.”

Wicked Adventure Co. disclaims all express or implied warranties, including:

  • Implied warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement

If a manufacturer warranty exists, it is solely between the customer and the manufacturer.

10. Limitation of Liability

To the maximum extent permitted by Arizona law, Wicked Adventure Co.’s total liability shall not exceed the amount paid for the product purchased.

We shall not be liable for indirect, incidental, consequential, or special damages.

11. Indemnification

You agree to indemnify and hold harmless Wicked Adventure Co. from any claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising from:

  • Your use of the product

  • A minor’s use of the product

  • Violation of these Terms

  • Violation of any law

12. Right to Refuse Service

We reserve the right to refuse service, cancel orders, or limit quantities at our sole discretion.

13. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Arizona, without regard to conflict of law principles.

Any disputes shall be resolved in a court of competent jurisdiction located in Arizona.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of the website or purchase of products constitutes acceptance of updated Terms.
